SHORT TERM RENTAL AGREEMENT

            This Short Term Rental Agreement (the “Agreement”) is made by and between Alan W. Traylor (“Homeowner”) and Guest as of the dates set forth in the email confirmation.  For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1.      Property.  The property is located at:

737 Viking Mountain Road

Greeneville, TN 37743

The property is furnished and includes linens, towels, dishes, silverware, pots & pans, washer/dryer, oven, gas/charcoal/smoker combination grill, gas oven, gas heaters (2), gas fireplace, wood stove, all furnishing (including tables, chairs, beds, couch, dressers, and lamps), flat screen TVs (2), Xbox 360, Xbox, 7.1 surround sound speaker system and stereo receiver, deck furniture (including 4 Adirondack chairs, large table, small table, 2 rocking chairs, 3 cypress chairs, and a cypress loveseat) & 6 hunter ceiling fans.

2.      Rental Party:  The rental party shall consist of only the amount of guests agreed to in the rental confirmation.  An additional charge of $25 per person per night for guests in addition to those initially agreed to will be assessed.

3.      Maximum Occupancy: The maximum number of guests is limited to 15 persons (unless approved by Homeowner). 

4.      Term of the Lease.  The lease begins at 4 p.m. on the check-in date and ends at 11 a.m. on the check-out date. 

5.      Minimum Stay:  This property requires a 2 night minimum stay. Longer minimum stays may be required during holiday periods. If a rental is taken for less than 2 days, the guest will be charged the 2-night rate.

6.      Rental Rules:  Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.

7.      Access:  Guest shall allow Homeowner or Homeowner’s representative access to the property for purposes of repair and inspection.  Homeowner shall exercise this right of access in a reasonable manner.

8.      Rental Rate and Fees

a.       Deposit:  A security deposit of $200 is due with the second and final payment made 15 days prior to arrival. 

The deposit is for security and shall be refunded within 7 days of the Checkout Date provided no deductions are made due to:

damage to the property or furnishings;

dirt or other mess requiring excessive cleaning; or

any other cost incurred by Homeowner due to Guest’s stay.

If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately. 

b.      Basic rental rate and fees are as follows:

$ 125.00 per night based on 2 person occupancy.  Fee for additional people is $25.00 per night for each additional 2 people.

     Cleaning fee                              $0 (included in rental amount)

     Sales Tax                                   @ 16.75% (per local/county taxes)

     Refundable security deposit      $200.00

     Pet fee if applicable                   $50.00 (per pet)

The rental rates specific to your reservation can be viewed in the confirmation email you received after your first payment.

9.      Cancellation Policy:  If Guest wishes to cancel his/her reservation, the deposit will be refunded as follows:

     100% if cancelled 30 days prior to the Check-in Date

     50% if cancelled 15 days prior to the Check-in Date

10.      Insurance:  We encourage all renters to purchase traveler insurance.

11.       Payment:  Acceptable payment methods are echeck or credit card through the VRBO.com or Homeaway.com websites.

Exhibit A

RENTAL RULES

1.      DO NOT trespass on ANY of the adjacent properties.  Signs clearly mark where VML property ends.   Obey the "NO TRESPASSING" signs on the perimeter of the property at all times and do not travel beyond them for any reason.  Make certain children and pets are supervised and do not wander onto private property.

2.      Smoking is NOT allowed inside the cabin. Smoking is allowed outside only.

3.     People other than those in the Guest party set forth above may not stay overnight in the property.  Any other person in the property is the sole responsibility of Guest.

4.      The Homeowners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

5.      Keep the property and all furnishings in good order

6.      Only use appliances for their intended uses

7.      Pets are permitted only with prior approval and the pet fee must be paid no later than with the final booking.  Please refer to the Pet Addendum  below.   

8.      Housekeeping:  There is no daily housekeeping service. While linens and bath towels are included in the property, daily maid service is not included in the rental rate.  We do not permit towels or linens to be taken from the property.

9.      Fireplace and gas heaters: The fireplace and gas heaters are non-vented propane gas. Please do not throw any paper or other combustible materials in the fireplace.

10.     Fire pit:  Do not throw bottles, bottle caps, plastic, or trash of any kind into the fire pit.  You will be charged garbage disposal fees if these items are found among the ashes.

11.      Water and Septic: The cabin is on a well and septic systems.  The mineral content in the water is high.  During a drought, the well water may have an odor.  The septic system is very effective; however, it will clog up if improper material is flushed.  DO NOT FLUSH anything other than toilet paper.  No feminine products should be flushed at anytime.  If it is found that feminine products have been flushed and clog the septic system, you could be charged damages to cover the cost of repairs.

11.      Storms:  No refunds will be given for storms. [Mountain roads can be curvy and steep. Gravel drives are well maintained; however, we highly recommend four wheel drive and/or chains during the snow months. We do not refund due to road conditions.]

PET ADDENDUM

It is hereby agreed by and between Homeowner and Guest that homeowner will allow guest to have the pet/pets agreed to during booking and no others in the vacation home upon and subject to the terms and conditions of the rental agreement and this addendum.

Guest hereby agrees to comply the following:

1.      Guest to pay additional pet fee in the amount of $50 per pet.

2.      Guest is responsible for cleaning up any/all pet refuse. 

3.      Pets are not allowed on furniture at any time.  Any evidence of pets on furniture may incur extra cleaning fees. 

4.      All pets are to be treated with a topical flea and tick repellent three (3) days prior to arrival.  Fleas and ticks are very rampant in this area and can cause harmful/fatal illness to humans and pets. 

5.      Pet must not cause damage to premises or furnishings. If damages are caused, the cost of the damage may be deducted from security deposit.

6.      Pet will not be left unattended for an undue length of time, either indoors or out. Pet will not be left unattended on the deck, porch, or in the yard.

7.      Homeowner assumes no responsibility for illness or injury that may incur to pets or humans while on the premises. 

The Guest shall be solely responsible for the pet while on the property.
